PROTECTED BY THE US CONSTITUTION

The U.S. Constitution protects the right to private contract primarily through the Contract Clause:

1. Contract Clause (Article I, Section 10, Clause 1)

"No State shall… pass any… Law impairing the Obligation of Contracts."

This clause prohibits state governments from passing laws that retroactively interfere with private contracts.
It reinforces the sanctity of private agreements and limits government interference.
However, courts have ruled that states can regulate contracts in the public interest, such as consumer protection laws.

Thomas v. Collins, 323 U.S. 516 (1945)

In general, members of an association do not fall under the jurisdiction of local, state, and federal governments and corresponding laws and regulations. The exception to this general rule is when the activities of the private membership association "present a clear and present danger of substantive evil". Thomas v. Collins, 323 U.S. 516 (1945).

As a type of unincorporated association, it is non-reporting
All members are under contract to protect each others’ activities

Therefore, activities are not subject to regulatory oversight, giving you a stronger power of choice
